Motorcycle riders of any age are at risk for accidents, and the lack of protection provided by motorcycles often results in tragic fatalities. Such was the case for a 55 year old Bohemia man this past Sunday.
Newsday reported that Victor Cinelli was struck by a 1997 Toyota Avalon as the driver was turning left on to Holbrook Road at the intersection of Portion Road and Holbrook. Cinelli was driving a 1989 Honda motorcycle. He was pronounced dead upon arrival at Stony Brook University Hospital.
Intersections are the most likely place for motorcycle accidents to occur, according to the most comprehensive motorcycle accident study ever conducted in the United States. The name of the study is the Hurt Report, and its findings also indicated that in intersection accidents, the other driver usually violated the motorcyclist’s right-of-way and often violated traffic signals. To give an idea of how extensive the study was, researchers in the Hurt study Report investigated more than 900 on-scene accidents, 3,600 police reports and later returned to 505 crash scenes during the same time of day, the same weekday and the same environmental conditions to evaluate traffic volumes.
While the investigation for the recent Suffolk County accident is ongoing, if the driver of the Toyota Avalon was at fault, there would be grounds for a wrongful death lawsuit.
