Suffolk County Personal Injury Lawsuit Deadlines

New York imposes strict deadlines on personal injury claims, and missing any one of them can permanently bar your right to compensation. The deadline that applies to your case depends on what type of accident occurred and who was at fault. Three common deadlines that may apply to your Suffolk County injury claim are:

30 days: No-fault benefits for motor vehicle accidents.

If you were injured in a motor vehicle accident in Suffolk County, you must apply for no-fault benefits within 30 days of the accident under New York Insurance Law Section 5106. No-fault covers your medical bills and a portion of lost wages regardless of fault. Missing this deadline can result in the denial of those benefits, which can leave you responsible for medical expenses while your personal injury case is still pending.

90 days: Claims against a municipality.

If your accident involved a Suffolk County road defect, a municipal vehicle, a government-owned property, or any other condition caused or maintained by a town, county, or public authority, you must serve a Notice of Claim within 90 days of the accident under New York General Municipal Law Section 50-E.
