Understanding No-Fault Benefits in New York
New York is a no-fault state, which means that after a rideshare accident, the host’s no-fault coverage pays for your initial medical treatment and a portion of lost wages regardless of who caused the crash. In New York, no-fault benefits are provided through the insurance policy on the vehicle you were in at the time of the accident, not necessarily the at fault party’s policy. For rideshare passengers, that means the Uber or Lyft vehicle’s policy is typically the primary source of no-fault coverage.
No-fault benefits can include:
- Medical treatment related to the accident, including emergency care, doctor visits, specialist consultations, physical therapy, chiropractic care, and diagnostic imaging such as MRIs and X-rays
- Lost wages up to $2,000 per month for up to three years if your injuries prevent you from working, subject to documentation from your treating physician
- Transportation costs to and from medical appointments when your injuries prevent you from driving or using public transportation
- Other reasonable out-of-pocket expenses directly related to the accident, such as prescription costs and medical equipment
No-fault benefits are not automatic. You must file a no-fault application within 30 days of the accident, and your medical providers must submit bills within 45 days of treatment. Missing these deadlines can result in a denial of benefits, even if your injuries are serious.
